These terms of use apply to Understeer and Tennis Max (jointly, the “Apps”, individually, the “App”), apps built by EMQM Limited and made available on the Apple AppStore. By downloading or using the Apps, you agree to the following terms and conditions (“Terms of Use”). If you do not agree to these terms, please do not use the App.

1. General Information

The Apps provides real-time updates, standings, and other related information for different sports including motorsports and tennis. It also includes widgets to enhance the user experience. All content is provided for informational purposes only.

2. Use of the Apps

The Apps are intended for personal, non-commercial use only. You agree not to use the Apps for any unlawful or prohibited purpose, or in a way that could damage or disable the Apps, impair the experience for other users, or interfere with the functioning of any services provided by the Apps.

3. User Accounts and Pro Plan Subscription

An account is automatically created to identify your device when the Apps are downloaded. This account is associated with your device’s unique identifier (UUID) and is used solely to manage your subscription to the Pro plan, if applicable. This allows for the restoration of your purchase in the event that you delete and reinstall the Apps.

No personal data beyond the UUID is collected or stored. You agree to maintain the security of your device and acknowledge that any purchases or subscriptions made through your account are your responsibility.

4. In-App Purchases and Subscriptions

Certain features or content within the Apps may require in-app purchases or subscriptions. You agree to pay all fees associated with these purchases or subscriptions. All in-app purchases are subject to the terms of the AppStore. You understand that subscription fees are charged automatically and will renew unless canceled within the AppStore’s settings.

5. Cancellation and Refunds

Subscriptions will automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your AppStore account settings. Refunds for in-app purchases and subscriptions are subject to the terms of the Apple AppStore.

6. Pro Plan Features

Each App has the provision for you to upgrade to a Pro plan. If you subscribe to the Pro plan, you will gain access to additional features and content within the Apps. Subscription terms, including pricing and duration, are clearly stated within the Apps. By subscribing, you agree to the terms of payment as outlined in the AppStore.

7. Third-Party Content and Services

The Apps may display content provided by third-party services, such as standings, upcoming and completed fixtures, match or race results, and other statistics. EMQM Limited is not responsible for the accuracy or availability of this content and does not guarantee that such information will always be current or error-free. We make no guarantees about the accuracy, reliability, or timeliness of such data and are not liable for any damages arising from reliance on this information.

8. User-Generated Content

The Apps may allow users to submit or share comments or reviews. You agree not to post any content that is offensive, inappropriate, defamatory, or violates any laws. We reserve the right to remove any content that violates these terms. By submitting content, you grant EMQM Limited, on behalf of the Apps, a perpetual, non-exclusive, royalty-free license to use, modify, or display your content.

9. Push Notifications and Communications

The Apps may send you push notifications related to important information about the content of the Apps, your account or other subjects you accept within the Apps’ settings. You can control the receipt of these notifications through your device’s settings. By using the Apps, you consent to receive these notifications unless opted out.

10. Licenses and Restrictions

We grant you a limited, non-exclusive, non-transferable license to use the Apps for personal, non-commercial use. You may not modify, reverse engineer, decompile, or attempt to extract the source code of the Apps. Any unauthorised use of the Apps, or its content, will result in the termination of this license.

11. Termination of Use

We reserve the right to terminate or suspend your access to the Apps at any time, without notice, for any reason, including breach of these Terms of Use. You may also discontinue using the Apps at any time by deleting it from your device. Upon termination, your right to use the Apps will cease immediately. In the event of a Termination, any subscription payment made by you will be returned in accordance with the terms of your subscription and the AppStore.

12. Age Restrictions

The Apps are not intended for use by individuals under the age of 13. By using the Apps, you confirm that you are at least 13 years old or have parental permission to use the Apps.

13. Updates and Changes to the Apps

We reserve the right to update, modify, or discontinue the Apps at any time, with or without notice. Any updates may introduce new features or modify existing ones. Continued use of the Apps after such updates signifies your acceptance of the revised terms.

14. Disclaimer of Warranties

The Apps are provided on an “as-is” and “as-available” basis. We make no warranties, express or implied, regarding the operation of the Apps or the accuracy, reliability, or availability of the information provided. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

15. Limitation of Liability

In no event shall EMQM Limited, its affiliates, or licensors be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Apps, including but not limited to damages for loss of data, use, profits, or other intangible losses.

16. AppStore Terms and Conditions

The Apps are made available to you through the Apple AppStore. Your use of the Apps is also governed by the Apple AppStore’s terms and conditions. In the event of a conflict between these Terms of Use and the AppStore terms, the AppStore terms will take precedence.

17. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of England, without regard to its conflict of law principles. Any disputes arising from these terms shall be resolved exclusively in the courts of England.
