Welcome to Swace – Your AI Tennis Coach (“Swace”, “App”). Swace provides amateur tennis players with AI-driven analysis to help them improve their game, focusing on areas like form, service, and footwork. By accessing or using Swace, you agree to these Terms of Use (“Terms”) and our Privacy Policy.

Please read these Terms carefully. If you disagree with any part, do not use the App.

1. Acceptance of Terms

By downloading, installing, or using Swace, you agree to be bound by these Terms. If you are under 18, you must have parental or guardian consent to use Swace.

2. Service Description

Swace provides automated, AI-based analysis for videos you upload of yourself playing tennis. Based on your video, the AI generates feedback regarding various aspects of your gameplay, such as form, service, and footwork. This feedback is for informational purposes only and is not a substitute for professional coaching.

3. AI Analysis and Limitations

Swace uses AI technology to analyze user-uploaded videos. There is no human review or manual intervention involved in this process. As a result, the feedback provided may not be complete, accurate, or suitable for every individual. Use the feedback at your own discretion. Swace is not responsible for any action taken based on the AI feedback.

4. User Responsibilities

•Account Security: You are responsible for maintaining the confidentiality of your device and account information. If you believe there is unauthorized access to your account, contact us immediately.

•Age Restriction: If you are under 18, ensure you have parental or guardian consent.

•Content Submission: Only upload videos of yourself playing tennis. Non-tennis-related videos may not receive feedback. Swace does not moderate content, and non-compliant videos may not be processed.

5. Data Collection and Privacy

•Videos and Analysis Data: Videos uploaded to Swace are stored temporarily for one week and are then automatically deleted. The feedback generated is stored as long as you have an active account.

•Data Deletion: We do not selectively delete data. If you want your data to be deleted, you must delete your user account.

•Device ID: We collect a device identifier (UUID) to manage your account and restore your subscription if needed. We do not collect or store any other identifiable personal data.

6. Subscription Terms

Swace offers both monthly and yearly subscription plans, with an option for a free trial. Your first video analysis is free of charge. After the free trial, you must subscribe to continue using Swace’s analysis features.

•Payment: Payment for subscriptions is managed through your iOS App Store account. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions via your App Store settings.

•Cancellation: If you cancel a subscription, you will retain access to Swace’s paid features until the end of your subscription period. No refunds are issued for unused portions of a subscription.

7. Content Ownership and Usage

By uploading videos to Swace, you grant us a temporary license to process the content for analysis. Swace does not retain permanent ownership of your content, which is automatically deleted one week after upload.

8. Liability and Disclaimers

•No Responsibility for AI Feedback: Swace provides AI-generated feedback which may not be accurate, complete, or tailored to all users. Swace disclaims all liability for any action you take based on AI-generated feedback.

•External Servers: Video content is processed using external servers. We ensure that these servers are secure, but we do not control their full operational processes.

9. Limitations of Liability

To the fullest extent permitted by law, Swace is not liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or relating to your use of the App or its feedback.

10. Modification and Termination

•Changes to Terms: Swace may revise these Terms at any time. We will notify users of any changes via the App. Your continued use of Swace after any changes constitutes acceptance of the new Terms.

•Termination of Service: Swace reserves the right to suspend or terminate access to the App at our discretion. Upon termination, your account and all associated data will be deleted.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes related to these Terms or your use of Swace will be resolved in the courts of England and Wales.
